Government surveillance, abuses of power and the supression of dissent kicked into high gear after 9/11, one documentary argued at the Tribeca Film Festival on Saturday night.
But the whistleblowers who exposed recent activities were hardly breaking new ground, because some of the same things were going on more than four decades ago, another Tribeca doc pointed out.
Both “Silenced” and “1971” tackle issues that reverberate in light of Edward Snowden's recent disclosures of the extent of domestic spying, and the risks some citizens take to expose activity they feel subverts the Constitition. The two films made for bracing and frightening conversations both onscreen and off on the festival's first weekend.
One key point: Disclosure of illegal government activities was a lot more damaging to the presidency of Richard Nixon, driven from office in 1973 because of government abuses and the subsequent coverup, than it was to the George W. Bush and Barack Obama administrations.
“The things that were illegal in Nixon's era are now legal under the Obama adminstration,” whistleblower and former National Security Agency staffer Thomas Drake said following the premiere of James Spione's “Silenced.”
Drake is one of the subjects of “Silenced,” and a participant in the Q&A that made up part of the festival's “Tribeca Talks” series of post-screening conversations. Another subject, attorney for former Justice Department lawyer Jesselyn Radack, was also on hand; the third, onetime CIA agent John Kiriakou, is serving a 30-month sentence in federal prison for confirming the name of an undercover agent to a reporter.
Drake, Radack and Kiriakou were all charged with violating the Espionage Act, a 1917 law that had virtually nothing to do with whistleblowing and had been used less than five times in 90 years before the Obama administration dusted it off.
“I had to finish the movie quickly because I wanted to be timely with the Edward Snowden revelations, but also because it could be a never-ending story,” said Spione. “While we were making the movie, there were six Espionage Act prosecutions under Obama. Then seven, then eight.”
At the same time, he said, the extent of government spying on its own populace has been shown to be far more extensive than he initially imagined.
“I don't know if there's any such thing as paranoia anymore,” he said of the Snowden revelations. “The scope of the program is just enormous.”
“Silenced” makes the damning case that the federal government, in hanging onto the expanded powers granted after 9/11, selectively uses the threat of prosecution not to go after true spies, but to harrass whistleblowers for revealing illegal activities or government scandals. In the film executive produced by Susan Sarandon, Spione artfully mixes three case studies from three different government agencies: Kiriakou spoke out against the use of waterboarding, Drake found the NSA hiding from Congress its culpability in missing signs that the 9/11 attacks were coming, and Radack grew incensed that the Justice Department was trying to hide emails that proved it ignored American citizen John Walker Lindh's constitutional rights.
All three spoke out – “If I remained silent, I'd be complicit in the subversion of the American Constitution,” Drake says in the film – and all three were charged under the Espionage Act. Only Kiriakou, who has young children and could not afford to fight the charges and lose, went to prison; the government dropped the charges against Drake, and was scolded by a judge for bringing them in the first place.
Radack is now director of national security and human rights at the Government Accountability Project, and counts Snowden among her clients.
Although Spione's film is at times heavy-handed in its use of portentous black-and-white reenactments, it is effective is showing how the weight of the government can be used against citizens under the anything-goes heading of the War on Terror.
“The biggest leaker of classified information in our nation is the U.S. government,” said Radack in the Q&A moderated by Pulitzer-winning Washington Post journalist Barton Gellman. “It happens on a daily basis to make themselves look good. But if someone does it to expose the biggest scandals of my generation, the full force of the government comes down on you.”

When an audience member asked if people who aren't doing anything illegal should really be concerned about the government keeping tabs on their activity, Drake offered a quick answer.
“The phrase you use, ‘You have nothing to fear if you have nothing to hide,’ is attributed to Joseph Goebbels, the Nazi minister of propaganda,” he said. “If you lose the First and Fourth Amendments, we're no longer America. It's that simple.”
In a fascinating backstory to the events chronicled in “Silenced,” Tribeca premiered Johanna Hamilton's doc “1971” on Friday night, and ran it again on Saturday. Her film also deals with citizens uncovering government wrongdoing – but as the title suggests, it goes back more than four decades, to the height of protests against the Vietnam War.
“1971” details a break-in at the FBI offices in Media, Penn. in March '71, in which eight activists stole bureau files and mailed them to press organizations. The files revealed a pattern of illegal infiltration and disruption of anti-war, black-power and women's-liberation groups, exposing the abuses of Hoover's bureau and identifying the incendiary Counter Intelligence Program, COINTEL-PRO, for the first time.
The revelations led to the first congressional investigation of the FBI, but the eight activists who staged the raid were never caught, and they never revealed themselves publicly until Hamilton's film. Their story is both a cat-and-mouse thriller, told in well-handled reenactments, and an examination of the the abuses of government power that could hardly be timelier.
In the end, perhaps sadly, a line from “1971” may best sum up the message of that movie and of “Silenced.” Interviewed on tape more than 20 years ago, a former FBI agent says of the bureau's abuses, “It's the nature of government. It happened. It will happen.”

A Pennsylvania high school student was suspended this week for having the balls to pursue the American dream of securing a prom date with Miss America herself, Nina Davuluri.
18-year-old Patrick Farves was cheered on by the student body at Central York High School in York, PA when he approached Davuluri with a plastic flower in hand in the middle of an assembly. School officials, however, were not pleased, and he was immediately taken to the principals office, where he received a three-day in-school suspension.
The exchange — which the administration warned Farves against beforehand after getting wind of his plan, according to the York Dispatch — has gained national attention, and inspired students to protest the punishment under a #FreePatty Twitter hashtag.
In response, the school released a statement explaining the decision to punish Farves for following his dream.
“It is not our practice to discipline a student for asking someone – even Miss America – to a school dance. However, it is our practice to set expectations for student behavior, to communicate those expectations and rules to students and families and to ensure those rules are followed within our schools,” the statement reads. ”Yesterday's event was a wonderful experience for our students and a once in a lifetime opportunity for our district, and it is a shame that the media wants to frame this story to sell papers and make headlines using a distortion of what actually occurred.”
Miss America released a statement, as well. Farves will still have to search for a prom date, but at least she was “flattered” and is on board with the #FreePatty movement.
“On Thursday, a student invited me to prom and gave me a flower while I was giving a presentation in York, Pennsylvania. I was flattered by the gesture although I am unfortunately unable to attend due to my travel schedule,” Davuluri wrote on Facebook. ”I later learned of the disciplinary action taken and reached out to the school in hopes that they will reconsider their decision.”

The student — who will likely down in his high school class’ history book as “the man, the myth, the legend” — has accepted his fate, and understands why he was punished by the school.
“I don't want to be the type of person to do something like that and then justify myself,” Farves told the York Dispatch. “All the people who were in [the assembly], they did a lot of hard work and probably spent a lot of time getting Miss American to our school, so I completely understand why they were frustrated.”

Prince released a new single called “Breakdown,” and you can listen to it for free.
The music icon dropped the new tune (below) just short of midnight on Friday, the same day he announced he's working on a new studio album.
The “Purple Rain” singer told late-night host Arsenio Hall in March that the song was coming, but didn't say when.
“There's a song we've just written called, ‘The Breakdown,'” he said. “One of the things that we try to do, though, is wait until we have other songs that go together with our favorites. That's why it takes a long time to come out with albums these days. You know, not being under contract, there's no rush.”
Under a new partnership with Warner Bros. Records, the label will release will release previously unheard material from the artist and a digitally remastered, deluxe 30th anniversary edition of his 1984 soundtrack to the film “Purple Rain.”
Prince didn't say when it would drop, but he did promise “a brand-new studio album is on the way.”

A severe allergic reaction to antibiotics has forced Miley Cyrus to postpone the remaining U.S. dates on her Bangerz tour until August.
According to a statement on the 21-year-old pop star's website, Cyrus “is continuing to recover from the severe allergic reaction she suffered on April 15.”
“Existing tickets will be honored on the new dates, which include previously cancelled and postponed dates,” the statement promises. “Additionally, two tour dates have been added in Pittsburgh and Chicago. The European leg of the tour will proceed as planned.”
Cyrus was forced to cancel a show in Kansas City on Tuesday after she was hospitalized due to the allergic reaction, and subsequently cancelled concerts in St. Louis, Louisville and Nashville this week.

White House Responds to ‘Deport Justin Bieber’ Petition: Is This the End for Our Famous Canadian Friend?
The White House has responded to 273, 968 Americans demanding the deportation of Justin Bieber, and unfortunately for concerned citizens hoping the pop star's green card would be revoked, the U.S. government Beliebs it would be an “improper” issue to address.
“Sorry to disappoint, but we won't be commenting on this one,” the White House's official response states. “The We the People terms of participation state that, ‘to avoid the appearance of improper influence, the White House may decline to address certain procurement, law enforcement, adjudicatory, or similar matters properly within the jurisdiction of federal departments or agencies, federal courts, or state and local government in its response to a petition.' So we'll leave it to others to comment on Mr. Bieber's case.”
The petition that was launched in January described Bieber as a “dangerous, reckless, destructive” presence in American pop culture.
“He is not only threatening the safety of our people but he is also a terrible influence on our nations youth,” the petition reads. “We the people would like to remove Justin Bieber from our society.”
Since the petition attracted over 100,000 electronic signatures, the Obama administration was required to respond. While it wouldn't weigh in on Bieber's positive or negative impact on American culture, it did use the opportunity to push the President's 4-step immigration reform plan.
“We're glad you care about immigration issues. Because our current system is broken. Too many employers game the system by hiring undocumented workers, and 11 million people are living in the shadows,” the response reads. “That status quo isn't good for our economy or our country. We need common-sense immigration reform to make sure everyone plays by the same set of rules. Not only is it the right thing to do morally, it's the right thing for our country.”

Could Apple Maps finally have discovered the existence of the Loch Ness monster? And, as a result, could the world finally recognize the existence of Apple Maps?
A satellite image (above) from Apple's version of Google Maps shows a mysterious white blob, with what appear to be a pair of flippers at its side, underneath the waters of Loch Ness in Scottish Highlands.
According to the totally-non-biased “experts” at the Official Loch Ness Monster Fan Club, a six month study has concluded the image is “likely” proof of the fabled monster's existence.
‘We've been looking at it for a long time trying to work out exactly what it is. It looks like a boat wake, but the boat is missing. You can see some boats moored at the shore, but there isn't one here. We've shown it to boat experts and they don't know what it is,” club president Gary Campbell told the Daily Mail. “Whatever this is, it is under the water and heading south, so unless there have been secret submarine trials going on in the loch, the size of the object would make it likely to be Nessie.”
Deep-sea biologist Andrew David Thaler said otherwise on Friday after taking a few minutes out of his day on Friday to study the image. Ironically, he used Google Earth to discredit the fan club's months of hard, analytical work.
“The accompanying image is a low-resolution satellite image of a boat wake, available, apparently, only on Apple Maps. There's really not deconstruction needed, it's a boat wake,” Thaler wrote on his blog.

He even found a handy-dandy GIF made from higher-resolution satellite images of what he believes is the very boat that created the wake in question.
While proving his point about the monster-sized boat wake, he also proved that Google is far better resource for monster hunters hunting monsters on their smartphone.
“Apple doesn't have it's own imaging satellites. The fact that the image only shows up in Apple Maps, not Google, is due to Apple either using a slightly different image set to stitch together a picture of the loch, or has a less robust algorithm for dealing with artifacts,” Thaler explained.
“Both the boat in the northern picture and the ‘ghost boat’ in the monster picture are about 20 meters long. There are no 20-meter long catfish. There are no whale sharks in Loch Ness (how would they survive in freshwater?). It's a boat,” Thaler continued. “If something looks exactly like a boat wake, in a place where there are plenty of boats, when a similar boat can actually be seen in the same region, it's a boat.”

Who's the man who put a baby inside Tila Tequila? Is there actually a baby inside Tila Tequila? No one can answer either question with certainty now.
Why would any part of us question whether this is legitimate? Because her penchant for lies and PR stunts makes Farrah Abraham look honest.

Bryan Singer was not in Hawaii in when a lawsuit claims he sexually abused a 17-year-old boy in 1999, and his lawyer says he's got credit card receipts, telephone records and production schedules to prove it.
“We now have documentary evidence proving that Singer was not in Hawaii during the time period he was alleged to have been there with Egan,” a representative from defense attorney Marty Singer's law firm told TheWrap. “As confirmed by his cell phone records, credit card statements and receipts, per diem payment records, and production schedule, Singer was filming a movie in Toronto, or otherwise traveling within the continental U.S. from August 1999 through early 2000.”
The movie was the first installment of 20th Century Fox's “X-Men” franchise, which was released in theaters in July of 2000.
“This was Bryan's first studio film,” Singer told the Associated Press. “Clearly, he's not going to take a break in the middle of this movie while you're shooting and prepping it to go to Hawaii.”
The lawyer did not release any of the records to AP, citing privacy for his client.
Michael Egan, the plaintiff in a lawsuit attorney Jeff Herman filed in Hawaii earlier this week, claims Singer forcibly sodomized him on multiple occasions — first at a pool party at an estate in Encino, Calif., then in Hawaii.
During the first of several Hawaii trips, Singer allegedly “put a handful of cocaine against Plaintiff's nose and forced him to inhale it” and “provided Plaintiff with a beverage which he drank which significantly impacted his consciousness and his motor skills” before anally raping him twice.
Singer's attorney has said the lawsuit was “completely without merit.”
Egan claims he was not the only underage boy who was abused, and his attorney Jeff Herman stated at a press conference in Beverly Hills on Thursday that he has other clients who will allege being abused in future lawsuits, as well.
“I've been contacted by other victims who were alleging they were abused by other Hollywood industry people, completely unrelated to Mike's case,” Herman said.
Herman has yet to respond to TheWrap's request for additional comment.

Unfortunately for the two-hour reality show, the trouble didn’t stop there: the Gordon Ramsay series took a 17% dive from its 8 PM (1.0/4) premiere April 11 and an 18% drop from its 9 PM (0.9/3) broadcast last week. On the gastrological flipside, NBC’s resident cannibal was served a much-appreciated meal. The sometimes unsteady Hannibal (0.9/3) took a big bite of the ratings to garner a 29% rise over last week. With less competition in its 10 PM time slot, that’s best that the thriller series has done in three weeks among adults 18-49. Additionally, last night’s episode was also up 30% among total viewers from its April 11 show to 2.930 million. “Captain America: The Winter Soldier” and “Rio 2” are neck-and-neck for the top box-office spot again this weekend, while the faith-based drama “Heaven Is for Real” surged past the dismal debut of Johnny Depp's sci-fi tale “Transcendence” on Friday.
Disney's Marvel superhero sequel has the inside track on its third straight No. 1 finish after a $9.5 million Friday put it on course for a $24 million Easter weekend total. Fox's animated musical brought $9.2 million and is on a $23 million pace, but the family crowd will determine who finishes on top. Last weekend, “The Winter Soldier” outperformed the singing parrots of “Rio 2” on Saturday and Sunday to keep the top spot. The Blue Sky Studios animated film is in more theaters than “Captain America,” 3,975 to 3,825, and that could make a difference.
“Winter Soldier” raised its domestic total to $184.4 million on Friday, topping the $176 million haul of “Captain America: The First Avenger” in just 15 days. It's up to more than $520 million globally.
But the real phenomenon this weekend is Sony Tristar's “Heaven Is for Real,” starring Greg Kinnear as a small-town pastor whose son claims to have seen heaven after a near-death experience. It brought in a strong $7.8 million Friday. Its $3,248 per-screen average in 2,417 theaters that was better than any film in wide release. Since its Wednesday opening, the $12 million film's estimated total is $14.8 million, and Sony is projecting it will take in $27 million for the five-day holiday weekend.
“Transcendence” brought in just $4.8 million Friday, which puts it on pace for a $12 million three-day total. That's well below the $20 million pre-release projections for the thriller, which was financed to the tune of $100 million by Alcon Entertainment and China's DMG Entertainment, and marks Depp's fourth box-office bomb in a row.
His last major score was “Pirates of the Caribbean: On Stranger Tides” back in the summer of 2011. His turns as Jack Sparrow in Disney's series of swashbucklers have taken in more than $3.7 billion, but it's been three years since the last one. “Alice in Wonderland” topped a billion dollars globally, but Disney's 3D extravaganza was back in 2010.
First night audiences gave “Transcendence” a crummy “C+” CinemaScore, in line with the critics, who have it at 19 percent positive on review aggregation site Rotten Tomatoes.
The low-budget horror spoof “A Haunted House 2” was fifth after taking in $4 million on its first day from 2,310 theaters. Distributor Open Road was projecting a $10 million weekend for the Marlon Wayans-Jaime Pressley comedy, well below the $18 million that the original film debuted with in January of 2013, before going on to take in $60 million worldwide.
Summit Entertainment's Kevin Costner football drama “Draft Day” held well. Its $2.1 million Friday was off just 40 percent from last week and puts it on pace for a $6 million second week that would lift its domestic total to nearly $20 million.
Summit's teen sci-fi adventure “Divergent” and Relativity Media's horror film “Oculus” followed, and both should finish the weekend with $5 million-$6 million. That would bring “Divergent” up to $133 million domestically after five weeks.
The Disneynature documentary “Bears” brought in $2.3 million in its first day in 1,720 theaters, and is on pace for a $5 million opening weekend.
Two other faith-based movies, “Noah” and “God's Not Dead,” came next.
Paramount's Darren Aronofsky-directed Biblical epic brought in $1.6 million Friday and should end the weekend at $4.7 million. That would up its domestic total to nearly $93 million after our weeks.
The $1.6 million Friday take for “God's Not Dead” was actually up four percent from last week, even though it dropped 102 theaters. It should wind up Easter weekend with around $3.8 million, which would lift the domestic total for the $5 million indie from Pure Flix Entertainment over $47 million after five weeks.
“Fading Gigolo,” the R-rated comedy written, directed and starring John Turturro and co-starring Woody Allen, got off to a good start for Millennium Entertainment with $58,000 from five theaters. If it stays on that pace, it will bring in roughly $177,000 for the weekend, which would be a roughly $35,000 per-screen average.
